Guilty gets life sentence in Alape elderly rape case

Mangaluru, 18 Nov 2014: The Sixth Additional District Sessions and special court to deal with rape cases has convicted the accused with life imprisonment in the rape and loot case of 69-year-old lady that took place on June 14, 2013 at Alape.

 

On November 14, the Judge had pronounced the accused as guilty and announcing the quantum of punishment in the case on Tuesday, November 18, the guilty has been given life imprisonment.

 

Background

On June 14, 2013, Nagesh (25), a mason by profession hailing from Chintamani of Chikkaballapur had raped a 69-year-old lady who was living all alone at Alape as her children were settled abroad.

 

Nagesh was involved in the construction of the house that was being built by one of the four children of the lady, next to her house.

 

On the fateful night, Nagesh had knocked the back door of the house of the loner lady at around 7.15 p.m. When she opened the door, he barged into the house and tried to rape her after threatening her.

 

All of her pleas that he is of her kids’ age and that he could take away all the valuables in the house and let go of her, fell on deaf ears. Nagesh brutally raped the ailing elderly and fled with valuables that were in the house, estimated at Rs 60,000.

 

The neighbours who came to know of this incident the following day lodged a police complaint with the Mangaluru rural police, who nabbed Nagesh from a forest area nearby.

 

Inspector Ravish Naik who had led the investigations had presented a charge sheet. A total of 21 witnesses were examined by the special court. Shivparasd was the public prosecutor.

 

Nagesh who refused to admit his guilt has argued that the lady had borrowed Rs 10,000 from him and when he demanded the money back she had accused him of rape.

 

After hearing the argument, Judge Pushpanjali has held Nagesh guilty of rape.

 

Quantum of Punishment

Apart from the rigorous life imprisonment under IPC section 376 (Rape), the judge has imposed a penalty of Rs 5,000. In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 2 years.

 

Under IPC section 448 (Trespass) court also sentenced the convict a simple imprisonment for six months and fine amount of Rs 1,000, In case the convict fails to pay the fine amount, he shall undergo simple imprisonment for 2 months.

 

Further under IPC section 397 (Robbery or dacoity) court sentenced him rigorous punishment for seven years and fine of Rs 5000 and In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 2 years.

 

Under IPC section 506 (Criminal intimidation) court sentenced him for 1 year simple imprisonment and fine of Rs 1,000, In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 6 months.

 

The Court has also made sure that the fine collected could be given to the victim as compensation.
